1. Scope
These terms govern the use of sns-console (the "Service"), an SNS inbox and customer management service provided by Junabel Miyazaki (the "Provider"). Users accept these terms by using the Service. The Service is provided under an individual agreement between the Provider and the user; where these terms and that agreement differ, the individual agreement prevails.
2. Definitions
- "User" means the client business and its staff who use the Service, as well as operators engaged by the Provider to run it.
- "Connected account" means an Instagram or other social media account that the user connects to the Service.
- "Message data" means direct messages, comments, attachments, and sender information obtained through a connected account.
3. The Service
The Service provides the following functions.
- Receiving, reading, and replying to messages sent to a connected account
- Tracking the handling status of each conversation
- Classifying the people who make contact and managing their funnel stage
The scope of functions provided is defined in the individual agreement. The Provider may change the content of the Service after giving prior notice to the user.
4. Account connection and external platforms
Connecting an account is subject to the Meta Platform Terms, the Meta Developer Policies, and the terms of each social media service. Users may connect only accounts they are authorized to use, and may disconnect them at any time. Changes, suspensions, or restrictions on the part of an external platform may make all or part of the Service unavailable.
5. Handling of data
The Provider uses message data only for the purpose of providing and improving the Service. The information collected, where it is stored, the processors involved, the retention period, and the deletion procedure are set out in the Privacy Policy.
Disconnecting an account stops the collection of new messages from that connected account; it does not by itself delete data already collected. Deletion is carried out per client, on a written request from the user through the contact form or otherwise, once the Provider has verified the user's identity. The Provider carries out the deletion without undue delay after confirming the request, and reports the result on request.
Before deletion, the Provider will provide an export of the data on request. Where data subject to deletion remains in backups or other copies, it is erased within a reasonable period according to the refresh cycle of those copies.
6. User responsibilities
- Managing connected accounts and credentials appropriately
- Responding to message senders in good faith
- Complying with applicable law and the terms of each platform when using the Service
- Handling information obtained through the Service appropriately
7. Prohibited conduct
- Connecting a third party's account without authorization
- Sending spam or other unsolicited messages
- Using obtained data outside the stated purpose, or disclosing it to third parties without good reason
- Unauthorized access, reverse engineering, or other analysis of the Service
- Interfering with the operation of the Service
- Acting in breach of law, public order and morals, or the terms of any platform
8. Fees
Fees and payment terms for the Service are set out in the individual agreement between the Provider and the user.
9. Intellectual property
Intellectual property rights in the Service and its software, design, and documentation belong to the Provider or the respective rights holders. Rights in message data remain with the user or the sender.
10. Disclaimer and limitation of liability
The Service is provided as is. The Provider does not warrant its fitness for a particular purpose, completeness, or uninterrupted availability, and is not liable for failures or specification changes on external platforms, communication failures, or the non-delivery or delay of messages. Except in cases of willful misconduct or gross negligence, the Provider's liability for damages is limited to the amount received under the applicable individual agreement.
11. Suspension and termination
The Provider may suspend or terminate all or part of the Service after prior notice, or with notice afterwards in urgent cases, in the following situations.
- Maintenance, inspection, or updates
- A fault or outage
- Restrictions imposed by an external platform
- Breach of these terms or the individual agreement by the user
Data is handled in accordance with Section 5 when the Service ends.
12. Changes to these terms
The Provider may amend these terms. However, changes that are disadvantageous to the user — including fees, the scope of liability, and the handling of data — are in principle made as amendments to the individual agreement, by agreement between the Provider and the user.
Where the Provider amends these terms, it will announce the amended content and the effective date at least 30 days beforehand, by posting on this website or by notice to the user. A user who does not accept the change may terminate the individual agreement before the effective date. This does not apply to formal changes required by amendments to the law, or to changes that are in the user's interest.
13. Governing law and jurisdiction
These terms are governed by the laws of Japan. The Naha District Court has exclusive jurisdiction of first instance over any dispute between the Provider and the user relating to the Service.
